『 Terms of service 』
Section I — General
✦ By commissioning me, you are purchasing my service as an artist only
✦ The artist reserves the right to refuse a commission without reason or explanation
✦ As the artist, I will retain rights to the artwork and I can post them on my socials (UNLESS YOU PAY FOR PRIVACY). I usually tag the owner of the commission, tell me in advance if you don't want to be tagged
✦ Sexual harassment, inappropriate and/or aggressive behavior of any kind will not be tolerated. Should this or a breach of the Terms of Service occur, the artist may stop or cancel the commission. NO REFUND
✦ All commissioned work is for PERSONAL USE ONLY and not to be resold. Please see "Section IV — Commercial Commissions" for any and all work commissioned in order to obtain a profit
✦ As a customer YOU CAN’T MODIFY, trace, edit, copy or add elements to my artwork
You may repost the artwork on any platform as long as it is fully credited and/or includes the watermark
✦ NONE OF MY ARTWORKS CAN BE USED IN ANY BLOCKCHAIN-RELATED TECHNOLOGY (including NFTs, AI, cryptocurrency, or future inventions in the space)
✦ Poor communication may lead to delays or even be a reason to halt the commissioned work
✦ The moment I receive the payment, it will be taken as you having read and accepted to all terms laid out
✦ REMOVING ANY ARTIST WATERMARKS IS A VIOLATION OF THESE TERMS
Section II — Work Process
✦ Deadline is 3 months after the sketch approval
✦ Turnaround time: 1 month to 3 months
✦ Turnaround time subject to the commissions waitlist status and the artist's life circumstances
✦ Work on your order will begin depending on your place on the waitlist
✦ All communication must be in English or Spanish
✦ OBLIGATORY REFERENCES!
➭ Be clear in explaining the details of your commission. The client must provide clear and concise references/descriptions of their character(s) in order to avoid confusion
✦ I'm open to new ideas as long they're not on my "I DON'T” list
✦ In order to determine the exact cost and any additional fees, please provide all the necessary descriptions and details BEFORE payment is sent
✦ As soon as I start your commission I'll notify you with the first sketch, at which point you can make only 3 free changes
➭ If the 3 changes granted to you during the Sketch stage are not used they do not carry over to the next stages
➭ You will be granted a total of 3 additional changes to be used, however you wish, among the Line Art and Base Color stages (Changes do not include big ones like modifying the entire composition/idea)
✦ You will receive a full-sized .png file of the drawing sent via MEGA link or your email
Section III — Payments, Prices and Refunds
✦ I will not start your commission until payment is PAID IN FULL UPFRONT
✦ It is expected that you deposit 100% of the agreed upon price upfront before I start. No exceptions unless otherwise discussed
➭ Payments will not be accepted after the first sketch, much less after finishing the commission
➭ Payment should be made immediately after the artist accepts the commission unless stated otherwise
✦ You are responsible for making currency conversions
✦ Prices are subject to change according to size, complexity, and/or detail of the piece at the discretion of the artist. Final prices stated by the artist are non-negotiable
✦ Prices are per character
✦ Prices per extra character: +80% of payment
✦ Privacy: +60% of total price (means I won't post WIPs or your commission in any of my socials)
✦ If a commission is required by a specific date and this has been agreed upon by both parties, the artist may apply an additional fee at their discretion for higher priority work
✦ Quotes may be provided at the client’s request. They do not represent the final price. They are only an estimate at that particular time and can be changed at any point in the future at the artist’s discretion
✦ Payments must be made on the platform of the artist’s choice: Paypal, Stripe, Clip. Solo en México: Transferencia, depósito bancario, OXXO.
✦ If payment is not made in a timely manner (48h) after I've placed the invoice, the commission will be canceled. Repeated counts of commissioning a project and failing to pay will result in blacklisting
✦ There are NO REFUNDS UNLESS, for some reason, I take more than 3 months to deliver the finished artwork and said refund will be handled like so depending on the stage of work:
➭ Sketch Stage - Refund up to 70% of total price
➭ Line Art - Refund up to 50% of the total price
➭ Base Colors - Refund up to 30% of the total price
✦ Before ordering, please make sure you have the funds and desire to hire and receive artwork from me
✦ If the client wishes to cancel the commission before payment, there are no repercussions. The commission will be canceled and no further action needs to be taken
✦ If you file a chargeback against me you will be blocked and you won't be able to purchase anything from me anymore, adding you to my black list.
✦ I am not responsible for any mistakes that are made on your part over the course of the transaction.
Section IV — Commercial Commissions
✦ If you wish to order a commission for Commercial use, the total price of the commission, as well as any other royalties, will be agreed upon upfront.
✦ The minimum price increase for Commercial use is +100% of the original price, meaning double the end sum. However, I reserve the right to charge more if I deem fit.
✦ The following cases are considered Commercial use:
➭ Reproducing and selling the artwork, publicly or privately
➭ Cases where you receive profit from a medium/platform where you have posted my artwork, (eg. Patreon, YouTube, Twitch, a personal site, business cards etc).
Section V — NSFW
✦ NSFW commissions are for 18+ buyers only, age verification will be requested upon contact
✦ For composition purposes I sometimes tend to crop bodies in the illustrations. Please tell me in advance if you do not want me to crop them
✦ I can do almost any fetish, but if something bothers me I reserve the right not to accept your commission (Ask first!)
